OUR COMMITMENT TO PRIVACY

At Niman Ranch (“Niman,” “we,” “us,” or “our”) we respect our customers and partners and understand that you are concerned about your privacy and the use of information we collect. We have created this Privacy Policy to explain our information practices so you will understand when and how information is collected, used, and shared with respect to our websites that link to this Privacy Policy (referenced collectively herein as the “Sites”).

WHAT INFORMATION DO WE COLLECT?

We may collect information about you directly when you provide it to us or automatically as you navigate through the Sites.

We collect certain information you submit to us directly such as when you subscribe to a newsletter or email list, create an account, submit feedback, fill out our contact form, or send us other communications. This can include information like your name, company name, email address, phone number, log-in information, and zip code or postal code. We refer to this information as “Identity Information.”

At times we may ask you to provide us voluntarily with additional information regarding your personal or business interests, experience or requests, which we may combine with other information that we collect.

We also automatically collect certain information relating to your interactions with us and our Sites, including information about your device and web browser, IP address, time zone, and cookies that may be associated with your device or browser. Additionally, as you browse the Sites, we collect information about the individual web pages that you view, what websites or search terms referred you to the Sites, and information about how you interact with the Sites. We refer to this automatically collected information as “Technical Information.”

We may collect Technical Information using technologies like the following:

  • “Cookies” are data files that are placed on your device or computer and often include a unique identifier.
  • “Log files” track actions occurring on the Sites, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Sites.

HOW DO WE USE INFORMATION?

We may use the information that we collect for any lawful commercial or business purpose. In general, we use the information we collect to serve our users and operate and improve our business. For instance, we use the information we collect to provide services you request, to analyze and improve our marketing and promotional efforts, to statistically analyze Site usage, to improve our content and product offerings, and to customize our Sites.

We may also use the information we collect to provide you with information we think may be of interest to you. For example, we may use the information we collect to deliver information to you that, in some cases, is targeted to your interests, such as targeted banners, new products, new services, and promotions.

Additionally, we use the information we collect to comply with our legal obligations and to maintain the security of our Sites. As an example of this type of use, we use Technical Information that we collect to help us screen for potential risk and fraud.

Note that we also may use information for purposes that you have consented to or that are otherwise disclosed at the time information is collected.

HOW DO WE SHARE INFORMATION?

We share the information we collect about you in limited ways, such as (i) with our service providers to perform business functions; (ii) part of a business transfer, (iii) when required by law or permitted to protect rights, property, or safety of us or others; or (iv) with your consent.

  • Business Functions.
    We may share information we collect with third parties acting as our service providers to perform functions that support our business, including for analytics and marketing purposes. In the event that we use third-party service providers to assist us in performing our business functions, we impose contractual restrictions that the third parties may not use or disclose your personal information for any other purpose.
  • Business Transfers.
    Information about our users and the Sites is one of our most important business assets. Therefore, information about our users may be disclosed as part of any actual or potential merger or acquisition, creation of a separate business relating to the Sites, sale or pledge of company assets as well as in the event of an insolvency, bankruptcy or receivership in which information would be transferred as one of the business assets of the company.
  • Protection of Niman Ranch and Others.
    We may release information we collect to comply with legal process or authority (e.g., a lawful subpoena, warrant, or court order); to enforce or apply our policies; to initiate, render, bill, and collect for amounts owed to us; to protect our rights, property, or personal safety of Niman Ranch, our users, our employees, or the public; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.
  • Consent.
    We may share information with your consent or as otherwise disclosed to you at the time of information collection or sharing.

We may share Technical Information, as well as aggregated or deidentified information, without limitation.

WHAT ABOUT BEHAVIORAL ADVERTISING & ANALYTICS?

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of us and others on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information that Advertising Providers collect about your use of the Sites and other sites or apps over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.

We adhere to the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles in connection with this interest-based advertising activity. You may visit the DAA Webchoices tool at www.aboutads.info to learn more about this type of advertising and how to opt out of this advertising on websites by companies participating in the DAA self-regulatory program. If you delete your cookies or use a different browser or mobile device, you may need to renew your opt-out choices exercised through the DAA Webchoices tool. Note that electing to opt out will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests. Additionally, your browser may offer tools to limit the use of cookies or to delete cookies; however, if you use these tools, our Site may not function as intended.

We may also work with third parties that collect data about your use of the Sites and other sites or apps over time for non-advertising purposes. LINKS TO THIRD PARTY SITES

The Privacy Policies of other organizations linked to from our Sites may differ from ours. We encourage you to read those policies. We are not responsible for the data collection and use practices of third-party websites or apps to which our Sites may link. Please read the privacy policies of other websites or apps that you use.

The Sites may also contain integrated social media tools or “plug-ins”, such as social networking tools offered by third parties. If you use these tools to share information or you otherwise interact with social media features on the Sites, those social media companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public. Your interactions with third-party social media companies and the use of their features are governed by the privacy policies of the social media companies that provide those features. We encourage you to carefully read the privacy policies of any social media accounts you create and use.

NETWORK AND INFORMATION SECURITY

We take reasonable steps to prevent unauthorized access to the information you provide to us, and we maintain procedures and technology designed for this purpose.

Some aspects of our Sites are accessible only through passwords or password protected accounts. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of our Site by any person using your password. Please advise us immediately if you believe your account or password have been misused.

DATA RETENTION

We will process and store information we collect about you only for the period necessary to achieve the purpose of the storage, or as permitted by law. When you place an order through the Site, we may maintain your Order Information for our records unless and until you ask us to delete this information.

INTERNATIONAL PRIVACY RIGHTS

This section applies to those that use our Sites from the European Economic Area, Switzerland, or the United Kingdom.

For the purposes of applicable EU data protection law (including the General Data Protection Regulation 2016/679 (the “GDPR”), we are a ‘data controller’ of the “personal data” we collect. As a data controller, we may be processing personal data in order to fulfill contracts we might have with you (for example if you make an order through the Sites), with your consent, or otherwise to pursue our legitimate interests, such as for operating our Sites, providing customer service, or developing products. We process personal data to pursue our legitimate interests when our legitimate interests are not overridden by your data protection rights.

Your Rights Regarding Personal Data. You may have the following rights, subject to certain exceptions and limitations:

  • The right to access personal information we hold about you;
  • The right to ask that your personal information be corrected, updated, or deleted;
  • The right to request that we restrict or block the processing of personal information about you;
  • Under certain circumstances, the right to data portability; and
  • Where we previously obtained your consent, to right to withdraw consent to processing your personal information.

If you would like to exercise these rights, please contact us at customer_service@nimanranch.com. You also have the right to file a complaint with the relevant supervisory authority (i.e., of your country or domicile) if Niman Ranch has not addressed your concerns.

Data Transfers. Additionally, please note that the personal data we collect may be transferred outside of Europe, including to Canada and the United States.

STATE PRIVACY RIGHTS

California, Colorado, Connecticut, Utah, and Virginia residents have certain rights under state privacy laws with respect to personal data we collect. If you are a resident of such states, this section of the Privacy Policy contains disclosures required by law for our individual customers (“consumers”) and explains rights that may be available to you.

If you are a California resident, this section contains disclosures required by the California Privacy Rights Act (“CPRA”) and also applies to “personal information” we process about our current and former business contacts, including partner-farmers, that is subject to the CPRA.

Personal Information We Collect and Disclose for a Business Purpose. In the preceding 12 months, we collected and shared the following categories of personal information about consumers and California business contacts:

  • Personal and online identifiers (such as first and last name, email address, or unique online identifiers);
  • Internet or other electronic network activity information (such as browsing history, search history, interactions with a website, email, application, or advertisement);
  • Geolocation information;
  • Professional or employment-related information, if you are a business contact;
  • Education information, if you are a business contact;
  • Inferences drawn from the above information about your predicted characteristics and preferences; and
  • Other information about you that is linked to the personal information above

We share personal data for interest-based advertising purposes but do not otherwise engage in “sales” of personal data as defined by the CPRA.

Categories of Sources. We collect personal information from the following categories of sources:

  • Consumers;
  • Business contacts;
  • Service providers;
  • Affiliates not under our brand;
  • Consumer data resellers and other business partners;
  • Nonprofit organizations; and
  • Government entities.

Why We Collect, Use, and Share Personal Information. We use and disclose the personal information we collect for our commercial and business purposes, as further described in the “How Do We Use Information?” and “How Do We Share Information?” sections of this Privacy Policy.

Recipients of California Personal Information. We disclose the categories of personal information we collect to the categories of third parties listed below for business purposes:

  • Business contacts;
  • Service providers;
  • Affiliates not under our brand;
  • Advertising providers;
  • Internet service providers;
  • Data analytics providers;
  • Operating systems and platforms;
  • Social networks; and
  • Government entities.

Your Rights Regarding Personal Information. Residents of certain states have rights with respect to the personal information collected by businesses. You may exercise the following rights regarding your personal information, subject to certain exceptions and limitations:

  • The right to confirm whether we are processing personal information about you.
  • The right to correct inaccuracies in the personal information we have collected from you.
  • The right to know the categories and specific pieces of personal information we collect, use, and disclose about you; the categories of sources from which we collected personal information about you; our purposes for collecting personal information about you; the categories of personal information about you that we have disclosed for a business purpose; and the categories of third parties with which we have shared personal information about you.
  • The right to request that we delete the personal information we have collected from you.
  • The right to opt out of processing and sharing of personal data for interest-based advertising. Please note that if you opt out of certain practices, we may be unable to provide you with some services. Additionally, we do not knowingly sell or share personal data of individuals under 16.
  • The right not to receive discriminatory treatment for the exercise of the above privacy rights.

Depending on your state, if you have submitted a request that you believe we have not fulfilled, you may contact us to appeal our decision by sending an email with the subject line “Appeal” to customer_service@nimanranch.com.

Verification Process and Required Information. Note that we may need to request additional information from you to verify your identity or understand the scope of your request, although you will not be required to create an account with us to submit a request or have it fulfilled. We will require you to provide, at a minimum first name, last name, email address, and we may need to ask for a mailing address and phone number.

Authorized Agent. You may designate an authorized agent to make requests on your behalf by verifying your identity and providing signed, written permission to the authorized agent to make the request.

CHANGES TO OUR POLICY

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. If we make changes to this Privacy Policy, we will post the new policy at this location. Please review this Privacy Policy on a periodic basis.
